A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. On May 24, 2015, the Defendant violated the Punishment of Violences, etc. Act (collectively, deadly weapons, etc.) driving D 1.2 tons truck, the Defendant’s wife on May 24, 2015, and driving two lanes along the two-lane roads in front of the Korean Teachers’ Credit Union Center in Yeongdeungpo-gu, Yeongdeungpo-gu, Seoul, by driving a D 1.2 tons truck, the Defendant, which is in possession of the Defendant, along the two-lanes. On the ground that the injured party E (53 years old) operating on the same road changed the bus line to two-lanes, the FF bus operated by the victim E (53 years old) operating on the same road without stopping the bus at the right side of the bus, on the ground that he operated the bus as “Ser,” the Defendant’s truck driving at approximately 700 meters section from the above road to the front road of Yeongdeungpo-gu, Seoul, with the foregoing dangerous objects attached to the bus operation of the bus, thereby hindering the victim’s route and threatening with other victims.
Accordingly, the defendant threatened the victim by using dangerous things.
2. On May 24, 2015, around 15:30 on the front of Yeongdeungpo-gu Seoul Metropolitan City, the Defendant: (a) threatened E with a bus by means of driving a bus attached to the bus owned by the victim Young Transportation Co., Ltd., a corporation operating the said bus; (b) stopped according to the bus stop signals of the signal signal, etc.; (c) when the bus stops from the truck according to the bus stop signals, the said bus cut off from the truck to the above bus one time, and (d) caused the repair cost to be KRW 243,850, 200.
Accordingly, the defendant damaged the property owned by the victim.
3. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Drivers, Violence, etc.) causes damage to the bus operated by the victim E (53 years old) at the time, place, and as described in paragraph (2) above, and temporarily stops while keeping the signal signal according to the bus stop signal.
