피고인은 2011. 12. 23. 13:50경 서울 은평구 C에 있는 D지사 사무실에서, 피고인이 담배를 피우고 여직원에게 욕설을 하고 행패를 부린다는 내용의 112신고를 받고 출동한 서울은평경찰서 E파출소 소속 경찰관인 피해자 F에게, D지사 지점장 G을 비롯한 다수의 직원과 민원인이 있는 가운데 큰소리로 ‘야 좆같은 새끼야. 웃기는 새끼야. 눈알을 콱 파버릴라. 에라이 개새끼야’라고 욕설을 하여 공연히 피해자를 모욕하였다.
