A defendant shall be punished by imprisonment for six months.

Punishment of the crime

The defendant had been aware that he had worked as an insurance designer in a corporation B, with intent to obtain money from the victim C of the insurance design of the above corporation.

However, in fact, the Defendant did not have property in arrears equivalent to KRW 100 million at the time, and paid monthly income the insurance premium that the Defendant had purchased under the name of another person for the insurance performance of the Defendant. Since the above apartment and redevelopment compensation was owned by the blood of the Defendant, the Defendant did not have any intent or ability to pay the above money even if he borrowed the above money from the injured party.

Nevertheless, the Defendant, as seen above, received KRW 3 million from the Defendant’s bank account (Account Number: G) in the name of the Defendant on the same day from the victim, and received from that victim, from that time until April 26, 2017, a total of KRW 31,338,924 over 13 times in total by the aforementioned method, as shown in the attached Table 1 of Crimes List 2017.

2. On July 2016, at the place indicated in paragraph 1, 2016, the Defendant entered the insurance allowance fraud into the victim’s false statement that “The victim would buy a life insurance policy under the name of the firstman, raising many people who wish to live in the life insurance policy, raising it as the result of the insurance contract, changing the insurance premium paid by the insurance company, and changing the insurance premium paid by the insurance company.”

However, the fact is that the defendant is paid the insurance premium of one year on condition that the insurance designer maintains the insurance contract for not less than one year and eight months, and if the contract is terminated within one year and eight months, the pre-paid allowance is paid.
