1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. On July 24, 2007, the Plaintiff concluded the instant insurance contract with the Defendant as the insured on July 24, 2007, with the main content of guaranteeing operating expenses or hospitalization expenses for injuries, diseases, etc. as the insured.
B. After entering into the instant insurance contract from August 6, 2007 to August 20, 2007, the Defendant began to receive KRW 319,190 as insurance proceeds after being hospitalized for 15 days from August 6, 2007, and received KRW 47,738,039 in total from the Plaintiff on the ground of a disease described in the “accident” as follows.
