1. It is confirmed that an insurance contract entered into between the Plaintiff and the Defendant is null and void.

2. The defendant shall be the plaintiff.

1. Basic facts

A. On June 22, 2005, the Defendant concluded an insurance contract in attached Form 1 (hereinafter “instant insurance contract”) with the content that the Plaintiff would receive hospital allowances from the Plaintiff when the insured and the beneficiaries of the non-life insurance are designated respectively as the insured and the beneficiaries of the non-life insurance.

B. After the conclusion of the instant insurance contract, the Defendant was hospitalized in B Hospital for 25 days from May 21, 2007 to June 14, 2007, including being hospitalized in B Hospital on the ground of acute infection, for 26 days from October 31, 2013, as shown in attached Table 2, and received insurance proceeds from the Plaintiff in total of 18,38,833 won according to the instant insurance contract.

C. Meanwhile, the insurance contract concluded between the Defendant and the insurance company including the Plaintiff before and after the conclusion of the instant insurance contract, as the insured, and the particulars of the insurance premium and the insurance amount paid accordingly are as listed in the table 1 below.
