1. The plaintiff A's lawsuit shall be dismissed.

2. The plaintiff B's claim is dismissed.

3. The costs of lawsuit are assessed against the plaintiffs.

1. Basic facts

A. The Plaintiff A is the father of the deceased D (hereinafter “the deceased”), and the mother of the deceased.

The defendant is a juristic person operating the E Hospital (hereinafter referred to as the “Defendant Hospital”).

B) (1) On May 13, 2017, the Deceased was admitted to the Defendant Hospital via the F Hospital, with a serious two copies around 09:56, and the medical personnel at the Defendant Hospital was suspected of brain dystrophism, and there was no special error in the body of the Deceased on May 13, 2017. (2) After the Deceased was hospitalized in the Defendant Hospital, the Deceased was hospitalized in the Defendant Hospital on May 13, 2017. (3) On May 13, 2017, the medical personnel at the Defendant Hospital complained of two copies at around 23:10 on May 13, 2017.

3) On May 14, 2017, at around 00:07, the Deceased divershed the toilets into a part of the toilet suitable for the toilets. C. On July 4, 2017, Plaintiff A filed an application with the Korea Medical Dispute Mediation and Arbitration Agency for mediation against the Defendant, and on October 24, 2017, the following mediation protocol (hereinafter “instant mediation protocol”) was prepared under the agreement on October 24, 2017:

§ 2017.1188. Conciliation provisions

1. The respondent shall pay 13,380,940 won consolation benefits to the applicant as an account in the name of the applicant until November 30, 2017, and with respect to the amount unpaid by the payment date, 15% per annum from the day following the payment date to the day of full payment shall be paid.

2. The Claimant waives the remainder of the claims and raises any civil or criminal claim or objection against the medical personnel related to the Respondent and the Respondent in connection with the instant case.
