1. Defendant A

가. 피고인은 2013. 2. 초순경 심야 시간에 전남 강진군 D에 있는 피고인이 거주하는 컨테이너 박스 안에서, 자신의 성적 욕망을 만족시킬 목적으로 피고인이 사용하는 유선전화로 E 센터에 전화를 걸어 F사업단 소속 상담사인 피해자 G(여, 30세)에게 “자지 뽈고 있어”라고 말하여 성적 수치심이나 혐오감을 일으키는 말을 상대방에게 도달하게 하였다.

나. 피고인은 2013. 2. 초순경 심야 시간에 피고인의 주거지에서, 자신의 성적 욕망을 만족시킬 목적으로 피고인이 사용하는 유선전화로 E 센터에 전화를 걸어 F사업단 소속 상담사인 피해자 H(여, 39세)에게 “보지 꼴래 보지, 보지 털 벗고 콱 씹을 보지 붙어 봐 보지”라고 말하여 성적 수치심이나 혐오감을 일으키는 말을 상대방에게 도달하게 하였다.

C.
