Reasons
Punishment of the crime
[criminal power] On July 30, 2013, the Defendant was sentenced to two years of imprisonment for fraud, etc. at the Incheon District Court. On December 23, 2013, the Defendant was sentenced to six months of imprisonment with prison labor for the crime of forging private documents, etc., and filed an appeal with the same court, and is still pending in the appellate court.
【Criminal Facts】
The Defendant is a person who operates the F Licensed Real Estate Agent Office in Seo-gu Incheon, Seo-gu.
1. Forgery of private documents;
A. On May 2, 2012, the Defendant, even though not delegated by U to enter into a lease contract with respect to 505, Seo-gu Incheon V buildings owned by U in the above office, entered the “AF” in the deposit column, “U” in the lessor column, “AF” in the lessee column, and affixed the said U’s seal attached to U’s name.
Accordingly, for the purpose of uttering, the Defendant forged one copy of the instant charter contract in U’s name, which is a private document on rights and obligations.
B. The Defendant, at the above date and place, did not have been entrusted with the conclusion of a monthly rent contract with AG for the above V buildings 505 at the above time and place, but entered the said BG seal that the Defendant had in advance, by using the computer in the form of the office rent contract for officetels, entered the “three million won” in the deposit column, “AF” in the lessor column, and “AG” in the lessee column, and affixed the said AG seal.
Accordingly, for the purpose of uttering, the Defendant forged one copy of the officetel charter contract in the name of AG, a private document related to rights and obligations.
C. On June 5, 2012, the Defendant, even though he/she was not entrusted with the conclusion of the lease contract with respect to 407, Seo-gu Incheon, Seo-gu, Incheon, AH owned by the said office, entered the “AF” in the deposit column, “AH” in the lessor column, and “AF” in the lessee column in the office’s name, and the Defendant had the prior possession of the Defendant on the side of the name.
