A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

At around 22:00 on March 16, 2014, the Defendant, after drinking alcohol, had been staying a proxy engineer at home without paying the fee on the ground that the proxy engineer did not properly park the vehicle of the Defendant, and the police officer reported 112 and paid the fee.

피고인은 같은 날 23:00경 안양시 만안구 D 경기안양만안경찰서 E지구대에 찾아가서, 위와 같은 이유로 가족들에게 창피를 당했다고 생각하여 “씨발놈들아, 아까 신고나온 새끼 전화번호 알려줘봐! 내가 낸 세금이 아깝다”라고 욕을 하며 소속 경찰관 F과 G를 향해 들고 있던 음료수 병을 집어던지고, 이에 F과 G가 피고인을 현행범인으로 체포하려 하자 ”개새끼들아 개소리 하지마. 나 죽어버릴꺼다“라고 고함을 치고 G를 향하여 주먹을 휘두르는 한편, 체포당하면서 피해자 F의 왼쪽 종아리를 깨물어 그에게 약 2주간 치료를 요하는 아래다리 부분의 열린 상처를 가하였다.
