Punishment of the crime
Defendant
A Co., Ltd. is a corporation established for the purpose of manufacturing and processing livestock products, and the defendant A is a representative director of the corporation B, who exercises overall control over the business of the corporation.
1. Defendant A
(a) No person shall sell any livestock product, the expiration date specified in the relevant livestock product, or treat, process, store, or display such product for sale;
Nevertheless, on January 16, 2014, the Defendant kept livestock products, the distribution period of which has expired (23 km up to September 11, 2013, the distribution period of which has expired until January 2, 2014) in freezing B Co., Ltd., Ltd., for the purpose of selling them.
(b) Livestock products, the standards for which are determined for the sale and storage of which are in violation of the labelling standards, such as the date of their manufacture, shall be marked in conformity with such standards, and shall not be sold or stored for the purpose of sale without such marking;
Nevertheless, on March 31, 2014, the Defendant: (a) took part in the process of manufacturing “F” at a manufacturing factory B, a transparent vinyl (850gs in total; 91.8kgs) and kept the name of the product, the period of distribution, the name of the raw material and its content, etc. on the sign without entering the date of manufacture, the name of the raw material, and its content in the sign; (b) stored the product for the purpose of sale by stating the name of the product, the distribution period, the telephone number of the business place, three; and (c) sold approximately KRW 7,300,000,000 at the land market price, where no indication meeting the labelling standards is indicated from January 31, 2010 to March
2. Defendant B
A. Defendant B, who stored for the purpose of selling livestock products with the expiration of the distribution period, had Defendant B, the representative director of Defendant B, keep the livestock products with the expiration of the distribution period as above for the purpose of sale at the same date, place as the above 1-A.
