1. Facts of recognition;

A. The Defendant, around October 19, 200, issued each credit card from Samsung Card Co., Ltd. on and around October 24, 200, and did not delay each payment.

B. On June 30, 2003, the Plaintiff acquired the credit card payment claim against the Defendant from Samsung Card Co., Ltd., and notified the Defendant of the above assignment of credit with the content certification on July 16, 2003. On September 30, 2003, the Plaintiff acquired the credit card payment claim against the Defendant from El Card Co., Ltd., and notified the Defendant of the above transfer of credit card payment claim with the content certification on December 8, 2003.

C. The claims of this case are as follows as of December 31, 2008.

According to the facts of the above recognition, the Defendant is obligated to pay damages for delay calculated from January 1, 2009 to January 25, 2009, the agreement rate of 28% per annum, which is the agreed interest rate of 45,617,567,567 won in total (7,767,681 won in total, interest and delay damages of 7,767,681 won in total, interest and delay damages of 4,130,128 won in the balance of the claim for use of the Samsung Card, and 4,753,600 won in the balance of the claim for use of Samsung Card from January 1, 2009 to the day of full payment, with interest rate of 14,130,128 won in the balance of the claim for use of the Samsung Card, from January 1, 2009 to the day of full payment of interest rate of 4,753,600 won.
