A is a general game providing business operator who operates a game room under the trade name of "E" located in Orecheon-gu D, and Defendant B is a business manager who manages and operates the game room in general.

No game products related business entity shall allow any person to gamble or perform other speculative acts using game products, or leave such person to do so.

피고인들은 함께, 2013. 8. 25.경부터 2014. 5. 11. 23:15.까지 위 게임장에서 일반게임물인 ‘미스터손’ 70대, ‘이모션’ 30대를 설치하여 그곳을 찾은 불특정 다수의 손님들이 1인당 여러 대의 게임기에 자동실행장치인 속칭 ‘똑딱이’를 이용하여 자동으로 게임을 진행할 수 있도록 하고, 게임기당 500원짜리 동전을 동전 투입구에 넣으면 게임 화면 좌측 하단 ‘CREDIT’창에 500점이 생성되고 ‘START’ 버튼을 누르면 게임이 실행되어 1게임당 100점씩 감소하면서 게임이 시작되어 5장의 카드가 펼쳐지고, 게임자는 1장의 카드를 들고 나머지 카드를 교체하여 최종적으로 가지고 있는 5장의 카드가 구성하는 무늬와 숫자에 따라 점수를 획득하며, 위와 같이 획득한 점수는 게임기 좌측 하단 ‘BANK’창에 적립되고, 위 쌓인 점수만큼 손님들이 요구하면 카운터에 있는 게임점수 카드 발권기를 이용하여 ‘게임머니 적립 카드’에 포인트를 적립하여 주었고, 손님들끼리 위와 같이 적립된 포인트를 매매하여 현금화하는 것을 묵인하였으며, 적립 카드를 소지하고 있는 손님 또는 제3자로부터 적립된 게임 포인트의 교환을 요구받으면 적립된 점수만큼 위 게임기에 입력해 주어 위 게임을 다시 할 수 있게 하였다.
