A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime

1. Fraud;
A. On December 21, 2017, around 02:25, the Defendant made a false statement to the effect that “The Defendant would pay KRW 2.50,000 won of the taxi rate to 30,000,00,000,00 to the Gyeong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-si
However, the defendant did not have the intent or ability to pay the taxi fee due to the lack of cash or physical card that can pay the taxi fee.
The Defendant: (a) by deceiving the victim as above; (b) caused the victim to operate the said taxi at around 05:10 on the same day, and thereafter, (c) acquired financial benefits equivalent to the above amount by not paying the said taxi fee.
B. On December 23, 2017, at around 02:59, the Defendant made a false statement to the effect that “The Defendant would pay a taxi fee calculated on the face-to-face basis to the front day of the ISY at the Hampo-si, Nampo-si, Busan, to the G taxi driven by the victim F, in the vicinity of the company bank located at the lower end of the Busan, Seopo-gu, Busan.”
However, the defendant did not have the intent or ability to pay the taxi fee due to the lack of cash or physical card that can pay the taxi fee.
The Defendant: (a) by deceiving the victim as above; (b) caused the victim to operate the said taxi at around 05:43 on the same day, and then, (c) did not pay KRW 325,080 to the said cab; and (d) obtained pecuniary benefits equivalent to the said amount by failing to pay KRW 325,080.

On December 26, 2017, the Defendant made a false statement to the effect that “The Defendant will pay a taxi fee calculated on the face to the front day of the Ulsan-gun located in the Ulsan-gun located in the Gyeongnam-gun,” which is operated by the victim J, by taking advantage of the eroscop intersection in the beero-dong at the time of Jinju-si.
However, in fact, the defendant has no cash or physical card, etc. to pay the taxi fee during the number of times.
