1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. (1) The Plaintiff entered into a delegation contract of litigation affairs and insurance contract with the Seoul High Court (Seoul High Court) regarding the case between Nonparty D, E, and the Plaintiff and Nonparty F, on or around August 2017, entered into a delegation contract for litigation affairs with Defendant B (hereinafter “Defendant B”) and entered into the delegation contract with the law firm around August 2017, and the Defendant B was in charge of the Plaintiff and F’s agency business.
(2) On the other hand, Defendant B entered into an insurance contract with Defendant C Co., Ltd. to compensate for damages for up to KRW 50,000 for Defendant B’s occupational negligence and for expenses incurred in dealing with accidents.
B. (1) The Plaintiff is the owner of H forest land in Gyeonggi-gun, Gyeonggi-do (hereinafter “instant land”). Nonparty F is the owner of a building 787.86 square meters (hereinafter “instant building”) and was suspended after construction of steel frameds on the instant land as the Plaintiff’s legal wife, and was tried to construct a new building on the instant land (hereinafter “instant building”).
(2) On October 2, 2014, the Plaintiff entered into a contract to sell the instant land and buildings with Nonparty D and E.
The land in this case was owned by Defendant A, and the owner of the building in this case was F, so a sales contract concerning the land and building was separately prepared, but a special agreement was attached thereto.
(2) The main contents of the instant sales contract are as follows: (a) each of the instant land sales contract and the instant building sales contract; and (b) each of the instant sales contracts is incorporated into two parts; and (c) each of the instant sales contracts is as follows.
[This case’s land purchase and sale contract] Article 1(1) of the Act provides that the seller and the buyer shall pay the purchase price by agreement as follows.
The purchase price of KRW 400,000 ( KRW 400,000) and the down payment of KRW 40,000 ( KRW 40,000,000) and KRW 360,000 ( KRW 360,00,000) shall be paid on March 31, 2015.
