Defendants shall be punished by imprisonment for one year.
However, for two years from the date of the conclusion of this judgment against the Defendants.
Reasons
Punishment of the crime
Defendants are Russia’s nationality; Defendant A is a short-term stay (period of stay: December 6, 2016) that entered the Republic of Korea around October 7, 2016 for tourism purposes; Defendant B is a short-term stay (period of stay: October 11, 2016) that entered the Republic of Korea around October 11, 2016 for tourism purposes.
1. Special larceny Defendants conspired to steals money and valuables by intrusioning on department stores and convenience stores.
On October 11, 2016, at around 20:25, the Defendants intruded into the headquarters of E department stores located in Jung-gu Seoul, Jung-gu, Seoul, by pretending to be customers, and used the cresh in “G” clothing store operated by the five-story victim F, and the Defendant A used the cresh of the five-story victim F, with the cresh of the victim’s retirement and in any way, the cresh of which amounting to KRW 279,00,000, the market price of which is equivalent to KRW 769,000, the 3 points of clothing, including the rush 1,000, the market price of KRW 519,00,000, and the 369,000,000, respectively.
Accordingly, the Defendants, together, stolen four clothing points of the total market value of 1,936,00 won.
B. On the 12th of the same month, at around 16:56, the Defendants: (a) intruded the victim I into the J convenience store operated by Yongsan-gu Seoul, Yongsan-gu, Seoul as a customer; and (b) made use of the gap in which surveillance was neglected; (c) Defendant A 1 fright to remove malodor equivalent to the market price of KRW 7,500; (d) Defendant B 2,500; and (e) Defendant B fright to the fright to the fright of KRW 2,500,000, respectively.
Accordingly, the Defendants, together, stolen money and valuables amounting to KRW 13,400,00 in total, the market price owned by the victim.
C. At around 22:00 on the same day, the Defendants invaded into the “G” clothing store operated by the 6th victim L of the said department store through underground parking lots and emergency stairs.
The defendants use the victim's crepit and any other crepit, and the defendant A's 2 DNA 729,000 won at the market price and 1,745,000 won at the market price.
