Reasons
Punishment of the crime
On December 26, 2003, the Defendant was sentenced to eight years of imprisonment due to a violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (special robbery, etc.) at the Busan District Court. On August 28, 2013, the Changwon District Court issued an order to attach an electronic tracking device for five years in relation to the above crime, and was subject to supervision and protection observation from September 9, 2013. On October 19, 2016, the Busan District Court issued an additional decision to comply with the duty to comply with the measurement of alcohol conducted by the protection observation officer.
Defendant,
1. On March 23, 2015, around the same day when a person returned home with her rent and alcohol after leaving the workplace, and was unable to possess a portable tracking device on the same day while going out at around 21:36 on the same day, leaving alone without any effort to restore any warning, thereby impairing the effectiveness of the location tracking device for one hour and 43 minutes until the time the person in charge of the protective observation device was sent to D Mat in Busan, Daegu, Busan, until the person in charge of the protective observation device was taken out, while leaving the workplace at around 21:36 on the same day;
2. On November 22, 2015, around 04:34, at the “F cafeteria” located in Geumcheon-gu, Busan, the Plaintiff left the Defendant’s house without any effort to restore any warning even when drinking alcohol and drinking alcohol, and left the Defendant’s house with a portable tracking device installed at the above mar’s house, and without any effort to restore the device, thereby impairing the effectiveness of the location tracking device for a period of one hour and 22 minutes until the Defendant’s employee visited the Defendant’s house to collect the portable tracking device collected from the above mar’s house;
3. On February 17, 2016, around 19:20, the Busan East-gu G market was under the direction of the staff member of the Location Monitoring Control Center to “on the ground that the portable tracking device voltage was low in a low-power condition,” but the order was refused and continued to take out all the portable tracking devices around 19:53 on the same day.
