Punishment of the crime

1. The Defendant and the instant related persons work as the head of the headquarters of D (D) located in the Busan Young-gu Office from August 2013 to January 2016, the Defendant is a person in charge of the performance of government-level research services ordered by the Korea Fisheries Department, etc., and the F is the vice president of the G Co., Ltd., a private company that performs government-level contracting services, such as port design and supervision services on the 6th floor of Seoul Gangnam-gu Building.

2. Specific criminal facts;

A. On May 2015, the Defendant: (a) took advantage of the fact that it is difficult for private enterprises that form a consortium with D to refuse the Defendant’s request for money and valuables in charge of conducting D research services for the purpose of receiving future research services, etc., in which D and related private enterprises in charge of duties to take advantage of the fact that it is difficult for them to refuse the Defendant’s request for money and valuables, etc., to receive money and valuables or receive entertainment, such as golf entertainment, from private enterprises.

On May 2015, the Defendant demanded F to re-money and valuables to the same purport through telephone conversations, etc. with the following purport: “F, the vice president of the G LUB, which ordered “H” jointly with D, which was ordered by the Korea Fisheries Department.” The Defendant demanded F to the effect that “F, the vice president of the LUB, which was the vice president of the LUB, would incur a lot of costs not to process the receipt of the DU research institute, and it would cause many difficulties, and a large amount of KRW 5 million,000.”

Accordingly, F issued KRW 5 million from J 3rd floor conference room in Yongsan-gu Seoul, Yongsan-gu, Seoul around July 13:30, 2015 to meet the above needs in order to obtain the convenience of the defendant in future research service contracts, etc.

Accordingly, the defendant received a bribe from F to receive five million won in relation to his duties.
