Defendant shall be punished by a fine of one million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

1. No person subject to the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. (Defamation) shall defame any third person by divulging facts openly through an information and communications network with intent to defame the person;

가. 2018. 2. 23.자 범행 피고인은 2018. 2. 23. 18:39경 경남 거창군 B에 있는 피고인의 주거지에서 피고인의 휴대전화기를 이용하여 C에 있는 ‘D’에 접속한 다음 피해자 E이 ‘A씨 얼굴보고 이야기 할까요 망신당하고 싶지 않으면 경고합니다.’라는 댓글을 게시하자 그 밑에 ‘A’라는 닉네임을 사용하여 “염병을.. 사고치고 빵갔다온지 얼마됐다고..”라는 내용의 댓글을 게시하는 방법으로 피해자에 대하여 공공연하게 사실을 드러내어 그의 명예를 훼손하였다.

B. On February 26, 2018, the Defendant: (a) connected to “D” in the above-mentioned manner in the Defendant’s residence; and (b) posted the victim E’s words “A as soon as possible,” using the medical clinic called “A” under the victim’s name, thereby impairing the victim’s reputation by openly revealing facts against the victim by posting comments on “A” under the victim’s residence.
