With respect to the claims set forth in the attached Table No. 1 of March 2, 2016 between Defendant G and Ecobromoto.
Reasons
1. Basic facts
A. Transition 1 of the instant commercial building construction project: Ecobropia Copia Co., Ltd. (hereinafter “Ecopia”).
1) The instant land is located in Kimpo-si H 1,084m2 (hereinafter referred to as “instant land”).
1) On the ground, “I” commercial buildings (hereinafter “instant commercial buildings”) are located on the ground.
(1) The Korea Investment Savings Bank (hereinafter referred to as the “Korea Investment Savings Bank”) has carried out the business of newly constructing and selling the shares; and
(A) On May 12, 2015, the Crocco Asset Trust Co., Ltd. (hereinafter “Crocco Asset Trust”) established on May 12, 2015 for the purpose of financing business funds from the Company and ensuring the performance of its obligations.
(2) On May 20, 2015, the Plaintiff entered into a real estate security trust agreement with the Plaintiff, and completed the registration of ownership transfer under the name of Crocco asset trust with respect to the instant land on the grounds of the said trust agreement. (2) As between September 17, 2015 and January 20, 2016, the Plaintiffs agreed to enter into a sales contract in the event of unsold parcels, even though the buyers of the instant commercial building were recruited at least once by means of public sale, and the sales contract or conditional sales contract for some of the instant commercial buildings and the sales contract for some of the instant commercial buildings, in the event of unsold parcels, the sales contract was concluded.
(hereinafter “each of the instant sales contracts”) concluded a contract deposit and an intermediate payment to the head of EcoBB, and the details thereof are as follows:
