1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. The Defendant’s position 1) The Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”) for the purpose of a housing redevelopment improvement project with the size of 180,198.7m2 and the size of 18,502m2 as a rearrangement zone in Gwangju-si.
(2) around 204, the Plaintiff, E-dong housing, and land owners constituted the “(tentative name) F Area Development Promotion Committee” for the redevelopment of housing units with a size of 78,220 square meters in the above E-dong Seoul Special Metropolitan City.
From the time of the establishment of the “(tentative) Reserve Committee for the Redevelopment of the F Area”, the Plaintiff was working as the general secretary and the chairman of the said Preparatory Committee.
3) G (at present, the president of the Defendant Union.)
A) Around 206, Hdong, I Dong, Jdong, Kdong, and E-Dong partially owned housing and land owners constituted the “N Housing Redevelopment Improvement Project Establishment Integration Promotion Committee” (tentative name) as the Chairman of G for the redevelopment of housing units in the above Ldong and Mdong. (B) The process of changing the housing redevelopment improvement project was 1) the luminous name market was O on April 9, 2009, 18 square meters in the broad name city, 180,198.7 square meters in the broad name city, 2) the luminous name city was designated as the “P Renewal Promotion Zone”; (2) the D Day 28,502 square meters in the broad name city was designated as the “P Renewal Promotion Zone”; and (3) the Posi and Qno renewal Promotion Zone was designated as the “B renewal Promotion Zone” in the form of the “B renewal Promotion Zone.
2) On December 4, 2009, the Governor of the Gyeonggi-do publicly announced “(tentative name) the Gyeonggi-do Promotion Committee for the Establishment and Integration of New Housing Redevelopment Projects” with the content that (i) the area of the P Renewal Promotion Zone is changed to 177,609 square meters, (ii) the area of the Q Renewal Promotion Zone is changed to 29,768.9 square meters, and (iii) the designation of change of the R District and the determination of the Urban Renewal Promotion Plan, which is the content that the size of the Q Renewal Promotion Zone is changed to 29,768.9 square meters.
