A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On November 12, 2013, the Defendant was notified of a summary order of a fine of KRW 3 million for a violation of the Road Traffic Act (driving) in the Goyang-gu District Court (Seoul District Court) on November 12, 2013, and on July 3, 2014, the Defendant was sentenced to a fine of KRW 5 million for the same crime, etc. in the same court, and has the same kind of power twice.

1. The Defendant in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents is a person engaging in driving a vehicle B.

On March 31, 2015, the Defendant driven the said car under the influence of alcohol 0.059% without obtaining a driver’s license on March 31, 2015, along the two-lanes of three-lane roads from the middle-speed road from the mountain intersection to the middle-speed.

Since there was a long distance crossing, the driver of the vehicle had a duty of care to reduce the speed prior to the entry into the intersection, to live the surrounding vehicle, and to safely drive the vehicle while maintaining the bus, to prevent the accident in advance.

2. On the date specified in paragraph 1, the Defendant driven the vehicle under the influence of alcohol with a blood alcohol concentration of 0.059%, without obtaining a driver’s license, from the front of the insular region in Yongsan-gu to the front of the same Gu C at about 2km.

Accordingly, although the defendant was punished twice or more due to drinking driving, the defendant is a driver's license under the influence of alcohol again.
