Defendants shall be punished by imprisonment for four months.

However, as to the Defendants for one year from the date of the final judgment of this case, the Defendants are above.

Punishment of the crime

Defendant

A is a person engaged in agriculture, and Defendant B is a person engaged in the collection of earth and rocks.

Defendant

A created farmland by collecting soil and rocks after obtaining permission for development activities from a regular Eup/Myeon market for E in his/her own possession.

Defendant

A intended to arrange the surrounding areas of the above farmland to make his own farmland a superior farmland, and requested Defendant B to perform a flat work of forests, farmland, etc. in the surrounding areas of the above E.

Defendant

B put the earth and rocks emitted from Defendant A’s request and the surrounding land into another construction site to make profits, and collected the following rocks from the land outside the permitted area at Defendant A’s request:

1. The Defendants’ co-principal

A. From April 5, 2013 to May 3, 2013, Defendants in violation of the Management of Mountainous Districts Act and the National Land Planning and Utilization Act performed development activities, such as gathering soil and rocks of approximately KRW 6,755 cubic meters from forest land with a total of 1,822 square meters, which was not permitted to collect earth and rocks.

B. The Defendants violated the Farmland Act and the National Land Planning and Utilization Act, without permission from the competent authorities, engaged in development activities, such as gathering soil and stones of 813 cubic meters from 2,373 square meters in the dry field area, and changing the form and quality, on the date and time specified in the preceding paragraph.

C. Defendants violating the National Land Planning and Utilization Act

At the time stated in the port, he/she engaged in development activities, such as gathering earth and stones from 444 square meters to 154 cubic meters in the area of L, M, N, P, Q, and Q.

2. Defendant A

A. From April 5, 2013 to May 3, 2013, the Defendant violated the Mountainous Districts Management Act and the National Land Planning and Utilization Act, the Defendant engaged in development activities, such as gathering soil and stones of approximately KRW 5,000 cubic meters from forest land of approximately 1,716 square meters in order to obtain permission for gathering earth and rocks.
