1. The defendant A shall be punished by imprisonment with prison labor for one year and by imprisonment with prison labor for eight months;

, however, from the date this judgment becomes final.

Punishment of the crime

1. Joint criminal conduct by Defendant A and Defendant C

(a) Any person who intends to collect earth or stone in a mountainous district shall obtain permission from the competent administrative agency;

Nevertheless, in March 2013, the Defendants collected soil and stones from 735 square meters of forest land located in Jung-gu in Jung-si, Jung-gu without permission from the competent authority, and collected soil and stones from 1,449 cubic meters of forest land located in Jung-gu, Jung-gu, Jung-gu, and 1,449 cubic meters of forest land from 748 square meters without permission from the competent authority on May 2014.

(b) Any person who intends to commit a violation of the National Land Planning and Utilization Act or a violation of the Farmland Act shall obtain permission for development activities from the competent authority, and any person who intends to collect earth or stone on farmland shall obtain permission for temporary use from the competent

Nevertheless, around March 2013, the Defendants collected soil and rocks from 2,337 cubic meters without obtaining permission from the competent authority for the temporary use of farmland for other purposes, and at the same time, without obtaining permission from the competent authority for the temporary use of farmland for other purposes.

2. A person who intends to obtain permission to alter activities to collect and develop earth and stones shall obtain permission from a competent authority, and a person who intends to obtain permission to alter the temporary use of farmland for other purposes shall obtain permission to change from a competent authority

Nevertheless, the Defendant collected soil and rocks from around January 2014 to April 30, 2014 on farmland of 17,914 square meters in Jung-Eup, Jung-si, M, K, N, and L, without obtaining permission for development activities and permission for temporary use of farmland for other purposes, and additionally collected soil and rocks from about 35,828 cubic meters without obtaining permission for temporary use of farmland for other purposes.

3. Defendant B limited liability company

A. The Defendant, who is his representative director, committed a violation under the above Paragraph 1 in relation to the Defendant’s business.

B. The Defendant, who is his representative director, committed a violation under the above paragraph (2) in relation to the Defendant’s business.
