Punishment of the crime

On June 4, 2014, the Defendant was a person who participated in the 6th nationwide local election, which was implemented on June 4, 2014 as a candidate for the basic election district in C constituency.

1. No person shall distribute any printed matter indicating the name of a candidate, except in accordance with the provisions of the Public Official Election Act, in order to influence the election, from 180 days before the election day to the election day, and in cases of preliminary candidates, it is permitted only to directly distribute printed matters indicating the name of a candidate, and in cases of preliminary candidates,

A. A. Around April 5, 2014, the Defendant employed three persons, distributed a total of 500 boxes for election campaign, on which the Defendant’s name is written, to the alleys of vehicles parked at the distance of Sungnam-gu, Sungnam-dong, Sungnam-dong.

B. Around April 21, 2014, the Defendant employed three persons, and distributed a total of 2,823 copies of the name cards for election campaign, on which the Defendant’s name is indicated, to put the name of the Defendant on the post of the D apartment unit in Seongbuk-gu, Seongbuk-gu, Sungnam-gu.

C. Around April 21, 2014, the Defendant distributed approximately 50 name cards for election campaign, on which the Defendant’s name is indicated, by placing them in the way of displaying 50 boxes for election campaign, in which the Defendant’s name is indicated, by mailing for each household of Seongdong-gu, Seongbuk-gu, Sungnam-gu, Seoul Metropolitan Government.

2. Any person who is prohibited from installing facilities, etc. shall not install, display, post or distribute advertising facilities, such as signboards, in which the name of a candidate is indicated, except those provided for in the Public Official Election Act, in order to influence an election from 180 days before the election day to the election day, and in cases of a preliminary candidate, install or put up signboards, etc.

From April 10, 2014 to April 14, 2014, the Defendant posted an election campaign phrase “A” on the LED electronic sign board installed at the Defendant’s home located in Seongbuk-gu, Seongbuk-gu, Sungnam-gu, Seoul, which is not an election campaign office.

3. The defendant shall be entitled to the payment of the election campaign price under Article 1(1).
