A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Larceny;
A. At around 18:30 on December 15, 2012, the Defendant: (a) removed the security text attached to the instant cigarette rink, which is located in the seat of 65-1, Dong-dong-dong-dong-dong-Dong-dong, Daejeon Branch of Home Puger, which is managed by the victim C (Woo-dong-dong 65-1) on the first floor; (b) cut off 13,500 won of the market price, which was displayed at the display stand by using the gaps of the victim’s surveillance negligence; and (c) cut off the said tobacco after removing the security text attached to the instant plastic rink, which contains one cigarette 25,00 won of the market price.
B. At around 18:30 on December 20, 2012, the Defendant: (a) removed a security tag attached to a plastic case containing a more 25,000 won amounting to the market price, which was displayed in a tobacco copon using a multi-use crepan that was stolen by taking advantage of the gap where the victim’s surveillance was neglected; and (b) cut off the said tobacco.
C. On December 22, 2012, the Defendant removed a package of goods equivalent to KRW 1,016,00,000 in total market price of KRW 230,000,00, which was displayed in the display stand by taking advantage of the gaps in the victim’s surveillance negligence, and then cut off the package of goods equivalent to KRW 1,016,00,00.
2. The Defendant, in collaboration with D on December 28, 2012, entered D in the foregoing place, from around 19:45 to around 20:02 on the same day, D’s network in and around the surrounding areas by taking advantage of the gaps in which the victim’s surveillance was neglected, and the Defendant continued to put in D’s door with a content equivalent to KRW 39,000 of the market price, which was displayed at the display stand by using the multi-use bags that stolen as above, as seen above, KRW 39,00,00 of the market price.
