1. The Plaintiff:

A. Defendant Lone Star Co., Ltd.: KRW 659,00,000 and its amount shall be from November 21, 2017 to November 201, 2018.

1. Basic facts

A. The Plaintiff is a company established for the main purpose of real estate development business, etc. for sales agency business, etc.

B. On March 14, 2017, the Plaintiff entered into a service contract with Defendant Lone Star Co., Ltd. (hereinafter “Defendant Lone Star”) on the vicarious recruitment of members of the Lone Star District Housing Association Project implemented in Ulsan-dong, Ulsan-dong, 1189 (hereinafter “instant service contract”).

한편 피고 주식회사 이스트팰리스개발(이하 ‘피고 이스트팰리스’라 한다)은 피고 스타루트가 이 사건 용역계약에 따라 원고에 대하여 부담하는 의무를 보증하였다.

The main contents of the instant service contract are as follows.

Article 2 (Basic Nature of Contract) (1) A (Defendant Lone Star) as the principal agent of the sale business, shall delegate to B, as the principal agent of the sale business, the services for soliciting the associations under this contract as proxy.

② 병(피고 이스트팰리스)은 본 사업의 주체인 (가칭)문수로 대공원 지역주택조합과의 업무대행계약에 의거 위임받은 바에 따라 본 계약상의 갑의 의무를 보증한다.

(3) Within the scope of this contract, Eul shall exercise overall control over the recruitment of union members of the object of this project (referring to the whole apartment complex of this project) on behalf of Gap, and Gap shall pay remunerations according to the results of soliciting union members of Eul.

Article 5 (Method of Providing Services and Payment) (1) A shall require B to pay 4,00,000 won per all household (excluding value-added tax) in return for the services provided to B under this Agreement.

[Matters of special agreement] Recruitment fees shall be KRW 4,000,000.

Provided, That 350 households shall be measured and paid 4,00,000 won per household for 350 households, and when 350 households are recruited, 70,000 won shall be paid collectively by applying incentives.

From 350 households to 350 households, 6 million won per household shall be paid.

Incentives are open to the public relations center.
