A defendant shall be punished by imprisonment for two years.

Punishment of the crime

1. The Defendant: (a) had a breathous mind to force the drinking people to take money and valuables at night; (b) had an influence of the subject matter, and had the victim C (51) who was under the influence of alcohol and returned home in the vicinity of the forced daily market; and (c) had followed the victim.

On April 7, 2018, the Defendant approach the victim at the front of the bus stops D in Seocheon-si, Busan, about 03:45 on April 7, 2018, and “Ism immediately.”

2. On April 7, 2018, at around 04:17, the Defendant, who attempted to commit fraud, ordered the victim’s “G main store” operated by the Victim F, located in Yangcheon-gu Seoul Metropolitan Government, to use the victim’s boxes as if the Defendant was the legitimate user of the Bank C Card, which was demoted as referred to in the foregoing paragraph 1, and was presented to the victim and sought to deliver the victim with a beer with the market price of 2.50,00 won. However, the Defendant refused approval as the theft report of the above C, and presented the said KB national card around 04:18, but this was also rejected, and the purport was not achieved.

Accordingly, the defendant had attempted to receive property by deceiving the victim.
