Defendant shall be punished by a fine of KRW 5,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and photographing);
A. On July 16, 2013, at around 20:20 on July 16, 2013, the Defendant: (a) taken a visual image of the victim’s sexual intercourse, where the victim E (n, female, 39 years old) who was in an internal-related relationship with the Plaintiff was exposed to his/her bathing room using the gap in which the victim E (n, female, and 39 years old) was exposed to his/her cell phone above the television line; and (b) taken a visual image of the victim.
B. On July 26, 2013, around 21:30 on July 26, 2013, the Defendant, at the guest room located in “Gmotour” F in Busan, taken the front image of the part of the victim who was off from the world by the foregoing method.
C. On August 20, 2013, around 19:30 on August 20, 2013, the Defendant, at the guest room located in the Busan BY, taken a dynamic image recording with the victim’s sexual intercourse.
At around 16:00 on September 11, 2013, the Defendant, at the guest room located in the JJ of the Busan District captain-gun, taken the image of the Defendant’s sexual intercourse with the victim by the aforementioned method.
E. At around 20:00 on November 28, 2013, the Defendant, at the guest room located in the Busan BY, taken a dynamic image of the Defendant’s sexual intercourse with the victim by the foregoing method.
F. On January 2013, the Defendant, at the guest room located in the “Mel” Lindo-gu Busan, Busan, the Defendant taken visual images of the victim’s chests by the aforementioned method.
Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame through a camera or other similar mechanism over six times, against his will.
2. On April 25, 2014, the Defendant, in violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (obscenity using communications media), sent the video pictures taken by the Defendant to the victim’s cell phone from the front line of the “Ostore” located in the Busan Suwon-gu, Busan, on April 22, 2014, to him/herself or another person.
