A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2020. 5. 21. 00:15경 정읍시 C에 있는 D 앞길에서 “가게 문을 닫으려고 하는데 손님이 나가지 않고 행패를 부리고 있다.”라는 112신고를 받고 출동한 정읍경찰서 E지구대 근무 경위 F, 경위 G가 피고인에게 귀가를 권유하자 화가나, “뭘 들어가 씨발놈아. 나 집어 넣어봐라 새끼야.”라고 욕설을 하며 왼 손으로 위 F의 턱 부위를 1회 올려 치고, 그 옆에 서 있던 경위 G가 피고인에게 더 이상 욕설하지 말 것을 경고하자 위 G에게 다가가 “야! 임마. 너 이리 와봐. 씨발 놈아. 니네 오늘 잘못 걸렸어. 사람 잘못 봤어. 씨발 놈아.”라고 욕설을 하며 손으로 위 G의 복부 부위를 1회 때렸다.

Accordingly, the Defendant interfered with the legitimate execution of duties by police officers concerning the handling of 112 reported cases.

1. The reason for sentencing under Article 62-2 of the Criminal Act regarding the order to provide community service and attend lectures was that the Defendant was arrested as a flagrant offender by exercising violence while continuing to talk with a prison police officer.

The execution of punishment is suspended on the condition of community service order and lecture order, taking into account the fact that the nature of crime is not good, the degree of violence is not severe, and the defendant has no record of punishment since 2011.

In addition, the defendant's age, character and conduct, environment, motive, means and result of the crime, and the conditions of all the sentencing shown in the arguments in this case, such as the circumstances after the crime, shall be determined in the same manner as the order.
