Reasons
Punishment of the crime
1. On December 21, 2015, the Defendants conspiredd to use the said car as a security deposit to obtain studio by cutting off the said car using one remaining knife, and Defendant A, as indicated in the following 2-Ga, at the convenience store near Ulsan-gu, Ulsan-gu, U.S., U.S. (D.) around 18:00 on December 21, 2015.
Then, on December 21, 2015, around 18:26, the Defendants: (a) opened the said passenger car and smart key to the said victim in front of I located in Ulsan-gu, Ulsan-gu; (b) around 19:00 on the same day, the Defendants returned to the said high-speed bus terminal adjacent to the said high-speed bus terminal where the victim lives in order to find the said passenger car at the same time; and (c) discovered the said car at the Judio-gu, Ulsan-gu, Ulsan-gu. Judio-gu.
Since then, Defendant B waiting in the scam room around the above scam room, and Defendant B moved Defendant B to the above scam room where Defendant B was waiting in the front of the 20:58 on the same day with the above scam which had been in possession of around the 20:58 on the same day and moved to the front of the above scam room (PC).
As a result, the Defendants conspired to steal the victim's vehicle.
2. Defendant A
(a) Where a transferee of an automobile in violation of the Automobile Management Act intends to re-transfer it to a third party, the transfer of ownership shall be made in his/her name before transferring;
Nevertheless, on December 12, 2015, the Defendant did not transfer the ownership of GNS Y car purchased through “K” under the name of the Defendant in the vicinity of the Suwon bus terminal located in 270 via the Internet “K,” and sold it by receiving 3.630,000 won from F ( South, 30,000 won) as described in the foregoing paragraph (1) before the I located in Ulsan-gu, Ulsan-gu, Seoul, as of December 21, 2015, in the name of the Defendant.
