1. The Defendant shall pay to the Plaintiff KRW 41,00,000 and the interest rate of KRW 15% per annum from March 3, 2017 to the date of complete payment.
Reasons
1. As to the cause of claim
A. On May 2013, the Plaintiff paid KRW 100 million to B (hereinafter “B”), and concluded to be supplied with fire fighting units. 2) After being supplied with 40 million fire fighting units, the transaction was terminated. On February 19, 2014, the Defendant agreed to pay KRW 60 million in installments each of the aforementioned advance payment obligations at KRW 20 million.
(3) On April 1, 2014, the Plaintiff received KRW 10 million from the Defendant, and C (the representative director of B) promised on May 21, 2014 to pay the Plaintiff KRW 50 million up to June 30, 2014. If the payment date is not strictly observed, the Plaintiff agreed not to raise an objection even if he/she is liable for the Defendant’s legal liability (Provided, That the payment period by promissory note is less than three months) was written and written. ) If the interest is in arrears for more than three months, B will lose the benefit of the time and immediately repay the entire obligation to the Plaintiff’s claim. The joint guarantor will discharge the same obligation as B’s obligation to the Plaintiff. On March 30, 2016, 200,000 won, which is part of the principal, will be repaid to the designated account.
