Reasons
Punishment of the crime
1. The Defendant did not have any income due to lack of occupation. The Defendant did not have any intent or ability to pay the gas station price even if he paid oil to the B Belgium car in the name of the Defendant at the gas station because there was no money and credit card.
around 00:30 on August 3, 2018, the Defendant was committed as if he were to pay the amount of gas to the victim E at the D gas station located in Suwon-gu, Suwon-si, Suwon-si, Suwon-si.
The Defendant was provided by the victim with oil equivalent to KRW 70,000 on the Defendant’s vehicle.
B. At around 13:50 on August 13, 2018, the Defendant, at the G gas station located in Suwon-gu, Suwon-si, Suwon-si, Y, 52,00 won, committed as if the Defendant would pay the amount of gas stations to the victim H.
The Defendant was provided by the victim with oil equivalent to KRW 52,00 on the Defendant’s vehicle.
2. The Defendant in violation of the Guarantee of Automobile Accident Compensation Act is a holder of a Belgium car.
No motor vehicle owner shall operate any motor vehicle on the road on which mandatory insurance is not subscribed.
Nevertheless, at around 13:50 on August 13, 2018, the Defendant operated the said car from the roads that he knows that the said car was not covered by mandatory insurance to the G stations located in F in Suwon-si, Suwon-si, Suwon-si.
