The part of the judgment of the first instance against the defendant shall be modified as follows:

The defendant shall transfer to the plaintiff the Suwon-si E.

Basic Facts

On December 19, 1987, the Plaintiff completed the registration of transfer of ownership with respect to the area of 634 square meters (hereinafter “Plaintiff’s land”) prior to Suwon-si, Suwon-si.

On May 21, 1997, the Defendant completed the registration of ownership transfer with respect to F. 195 square meters (hereinafter “Defendant’s land”) located in Suwon-si, Suwon-si, which is adjacent to the Plaintiff’s land. On August 2, 1997, the Defendant constructed a house of 98.7 square meters on the Defendant’s land (hereinafter “Defendant’s building”) of the 1st floor of the Gyeongyang-si, Suwon-si, Suwon-si, which is located in the Plaintiff’s land, and used it as a religious facility and a house under the name of “Seoul-si,” after completing the registration of ownership transfer with respect to the above building on September 19, 197.

The Defendant, among the Plaintiff’s land, installs three sn beam beam lines on the steel file with the size of 0.15m x 0.15m. Of the Plaintiff’s land, each point of 2,3,18, 17, and 2, among the Plaintiff’s land, connected each point of 1m2, 30, 7, 33, 32, 31, and 30m of concrete floor and the attached Form 2, each point of 30, 7, 32, 31, and 30m in each part of 1m of land connected to the Plaintiff’s land, shall be deemed as “the part occupied by the Defendant” and each of the above parts shall be deemed as “the part occupied by the Defendant” and “the part occupied by the Defendant 1m2m2, 5m2m2).

Meanwhile, among the Plaintiff’s land, each point of 15, 16, 17, 18, 19, 20, 48, 49, 50, 51, 52, 53, and 15, among the attached drawings 2, attached Table 15, 16, 17, 18, 19, 20, 48, 49, 50, 51, 52, 53, and 15, connected to 7m of part of 1 in the ship, is connected to 30m of 7m in the same map, 20, 21, 22, 46, 47, 48, and 20m in the same order, 34m in the ship’s 22,23,24,25, 26, 28, 34, 36, 37, 34, 45, and 344m in each of 2.
