Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. No person who violates the Resident Registration Act shall unlawfully use another person's resident registration number;

Nevertheless, around 17:23 on June 21, 2019, while the Defendant smoked in the non-smoking area of an express bus terminal south line, which was located in Seocho-gu Seoul Seocho-gu as a new distribution in Seocho-gu, Seoul, in a non-smoking area, the Defendant sent a photograph of B’s resident registration certificate (C) being kept in his/her cell phone gallon, to the above public official, and carried out as B.

Accordingly, the defendant used another person's resident registration number unlawfully.

2. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection shall make any codes, words, sound, image, or motion picture creating fear or apprehensions to any other person repeatedly reach an information and communications network;

그럼에도 불구하고 피고인은 2019. 11. 20. 11:48경 진주시 D에 있는 자신의 주거지에서, 피고인 휴대전화(E)의 카카오톡 어플을 이용하여 피해자 F(64세)의 지인인 B에게 “G에게 말없이 떼고 보내지 않은 돈 금 175만원인가 오늘 중으로 G씨에게 보내지 않으면 F는 평생 숨어 살아야 할 것 같다 !!”라는 메시지를 전송하여 위 B이 이를 피해자에게 전달하도록 한 것을 비롯하여 그때부터 2019. 11. 27.까지 별지 범죄일람표 기재와 같이 총 7회에 걸쳐 공포심이나 불안감을 유발하는 문언 등을 반복적으로 피해자에게 도달하도록 하였다.
