Reasons
Punishment of the crime
1. Defendant A
A. On November 30, 201, the Defendant: (a) around 03:15 on November 30, 201, and around 97-1 of Yongsan-gu Seoul, Yongsan-gu, Yongsan-gu, the Defendant: (b) arrested the E box dispatched after receiving 112 report of drinking driving as an act of committing a violation of the Road Traffic Act from the slope F of the E box affiliated with the E box called “I H, I am not driving; and (c) arrested the sloping F with the face of the slopeF one time at the right side of the slopeF; and (d) assaulted the knebbbbb in the left side of the slope G.
Accordingly, the defendant interfered with the legitimate execution of official duties by police officers on the arrest of flagrant offenders.
B. On November 30, 201, at around 03:15, the Defendant was arrested in the act of violation of the Road Traffic Act and proceeded to the Yongsan Police Station on the charges of violation of the Road Traffic Act. On the same day, at around 04:15, the Defendant was required to take a drinking test from the driver of the traffic safety department belonging to the Yongsan-gu Seoul Metropolitan Police Station on the front side of the 97-1-dong, and was called out after receiving 112 report on the drinking driving, and the Defendant was found to have driven under the influence of alcohol, such as the slopeF, etc. affiliated with the police box where the Defendant was called out after receiving 112 report on the drinking driving.
C. The Defendant: (a) while driving a motor vehicle under the influence of alcohol as stated in the foregoing paragraph (a), and (b) at around that time, asked B, who was a four-way driver, to “the police station’s punishment was driven and the police station’s punishment was stated as driving and requested.”
A consent B was made on December 14, 201 and December 14:28, 201, and on December 16:38, 201, on two occasions at the transportation investigation team office of the Seoul Yongsan Police Station, and on two occasions at around 16:38, the accident occurred while driving.
