2. 피고인은 2012. 8. 19. 23:30경 전북 완주군 D 소재 E 모텔 309호실에서 동거녀인 피해자 F(여, 37세) 등과 함께 술을 마시다가 피해자로부터 “넌 사기꾼이다. 부모님이 살아 계실 때 사기치는 것을 알려주어서 이렇게 사기를 치고 다니느냐.”라는 말을 듣자 순간적으로 격분하여 피해자에게 욕설과 함께 “싸가지가 없다. 너 같은 년은 맞아서 죽어야 한다.”고 말하며 손으로 피해자의 머리카락을 움켜쥔 채 벽에 수회 부딪치게 하고, 주먹 등으로 피해자의 얼굴 부위를 수회 때려 피해자에게 약 28일간의 치료를 요하는 안와 하벽 및 내벽의 골절상 등을 가하였다.
