A defendant shall be punished by imprisonment for not less than eight months and by a fine not exceeding 1,00,000 won.

However, the period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From April 29, 2010 to around 1128, the Defendant is the representative of the E-learning to collect and transport wastes generated from the operation of discharging facilities or facilities under Article 2 subparag. 1 through 5 of the Enforcement Decree of the Waste Management Act in his/her place of business under Article 2 subparag. 3 of the Act on the Control of Wastes in the Place of Business, and wastes generated from places of business under subparagraphs 7 and 9 of Article 2 of the Enforcement Decree of the Waste Management Act, other than “waste generated from the place of business” discharged from each of the above places of business, and wastes generated from the places of business under Article 2 subparag. 7 and 9 of the Enforcement Decree of the Waste Management Act; and both wastes generated from the places of business and daily wastes generated from the places of business (see Articles 2 subparag. 3 and 13 subparag. 1, 2010; Article 7(2) of the Enforcement Decree of the Waste Management Act; Article 14 of the Enforcement Rule of the Waste Management Act).

On March 1, 2015, the Defendant was entrusted with the disposal of wastes buried and dumped on the said site by the owners of 6 lots of land in the racing city F, G, H, I, J, and K on March 1, 2015.

No person shall dump wastes in any place other than those prepared by a Special Self-Governing City Mayor, a branch office of a Special Self-Governing Province, the head of a Si/Gun/Gu, or a park or road manager

In addition, no person may reclaim or incinerate wastes at any place other than the waste disposal facilities permitted, approved or reported.
