1. All appeals filed by the Defendant (Counterclaim Plaintiff) against the principal lawsuit and counterclaim are dismissed.
2. The costs of appeal shall be principal lawsuit and counterclaim.
Reasons
1. The defendant's appeal citing the judgment of the court of first instance is not significantly different from the argument in the court of first instance, and the fact-finding and judgment of the court of first instance are justified even if the evidence submitted in the court of first instance is not presented in the court of first instance.
Therefore, the reasoning of this court's judgment is the same as the reasoning of the judgment of the court of first instance, except where "Article 13" in Part 3 of the judgment of the court of first instance is deemed to be "Article 12", and therefore, it shall be cited as it is by the main sentence of Article 420 of the Civil Procedure Act.
2. In conclusion, the judgment of the court of first instance is just, and the appeal against the defendant's principal lawsuit and counterclaim is without merit, and all of the appeals are dismissed. It is so decided as per Disposition.
