A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
From May 2013, the Defendant had been working in a financial institution near the middle-gu Seoul Metropolitan Government's shopping mall as a telephone in an influorial loan fraud office, and was under investigation by an investigative agency, the Defendant had been able to continue to commit the loan fraud since around September 2013 by allowing the method of committing the loan fraud.
On September 2013, the Defendant made a false statement to the effect that, at the Defendant’s residence located in Seoul Central District Office No. 202, the victim E calls, “B is the head of the “G” team working in the F Savings Bank, and the customer N.W. is eligible to refund up to 80 million won. In order to obtain a loan, it is necessary to first deposit interest for three months in advance, and later, it is possible to receive a loan at the time of the payment of security and credit management expenses.”
However, even if the defendant did not work for the Financial Savings Bank and received the money under the pretext of interest, etc. from the victim, he did not have any intention or ability to allow the victim to obtain the loan.
Around September 6, 2013, the Defendant, by deceiving the victim, received KRW 361,420 from the victim via the Agricultural Cooperative Account (Account Number: I) in the name of H used by the Defendant as a prior interest and interest.
In addition, from September 6, 2013 to April 16, 2014, the Defendant obtained a total of 81 times of loans, such as the contents in the annexed crime list, and acquired a remittance of total of 25,406,828 won from a victim in terms of various financial costs.
