Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is a person who works at the (ju)B prior to the issuance of pigs after entrusting the raising of pigs to a farm.

On July 2016, the Defendant requested D, the owner of the C farm, to obtain eco-friendly certification, to request the implementation of the above certification procedure. However, on January 2019, the Defendant forged “safety manager certificate” in the name of the president of the Korea Institute of Certification of Goods Safety, which is necessary for filing an application for certification, to conceal the fact that he/she failed to implement the procedure by January 2019, and had the intent to deliver it to the said D.

1. 사문서위조 피고인은 2019. 1. 7.경 전주시 완산구 E빌딩 7층에 있는 ㈜B 전주지점 사무실에서 그 무렵 F으로 입수한 현진농장 운영주인 G가 2018. 12. 7.경 한국식품안전롼리인증원장으로부터 발급받은 ‘안전관리인증(작업장ㆍ업소ㆍ농장)(HACCP)인증서’ 파일을 출력한 다음, 사무실에 있는 컴퓨터 문서작성 프로그램을 이용하여 “H, 영업자(농업인) : D, 회사명(농장명) : C농장, 소재지 : 전라북도 임실군, 적용업종 : 가축사육업, 가공품 유형 : 돼지, 중요관리점 : CCP-1C 출하, CCP-1P 출하, 유효기간 : 2017년 01월 07일부터 2019년 01월 06일까지,「축산물 위생관리법」제9조 제6항 및 같은 법 시행규칙 제7조의3 제6항, 제7항, 제9항 또는 제7조의5 제5항, 제6항에 따라 안정관리인증(작업장ㆍ업소ㆍ농장)(HACCP)으로 위와 같이 인증함, 2017년 01월 07일”이라는 문구를 작성 및 출력하여 그 부분을 오려붙인 후 복사하였다.

Accordingly, the defendant forged the safety management certificate in the name of the Director of the Korea Food Safety Management Certification Board, which is a private document about the certification of facts.

2. On January 8, 2019, the Defendant issued a forged safety management certification copy as if he were issued a genuine copy to the foregoing D, who knew of the forgery in the former North Korean Office I, around January 8, 2019.
