1. The part against Defendant B among the judgment of the court of first instance is revoked, and the plaintiff falling under the above revoked part is against Defendant B.

1. In the claim against Defendant B, the Plaintiff claimed compensation for consolation money and damages for delay of KRW 2 million by asserting that the comprehensive sexual harassment, intimidation, and coercion against Defendant B was an unlawful act in the first instance court. The first instance court ordered payment of KRW 700,000 and damages for delay against sexual harassment on June 2012, and dismissed all the remainder of the claim.

Since only the above defendant appealed against this, the subject of the judgment of this court against the defendant B is limited to the claim for consolation money due to the above sexual harassment.

2. The Plaintiff’s basic facts do not conflict between the parties that the Plaintiff served in the subway Corporation as D from March 2012 to March 2013, 2013 with the Defendants.

가. 피고 B에 대하여 동료 D이던 피고는 ① 2012. 4. 27. E역 D 대기실에서 막차를 타려고 기다리던 중 원고가 농담조로 “내가 여자 D 중에서 얼굴이 제일 예쁘지 ”라고 묻자, “5명 다 얼굴은 아니야, 얼굴이 아니다, 그러면 이제 몸매를 봐, 여자는 좀 만질 게 있어야 돼.”라고 말하고, ② 2012. 5. 7. F역 앞에서 모여 있던 중 원고에게 “애 둘 낳은 아줌마 아니에요 ”라고 농담조로 물어 원고가 “애 둘 낳은 아줌마가 이렇게 허리가 가느냐 ”라고 답하자, “가늘기만 하면 뭐해 너무 볼륨이 없잖아 ”라고 말하고, ③ 2012. 6월 말 원고의 고충을 전해 들은 G으로부터 원고에게 다시는 성적 불쾌감과 굴욕감을 주는 말을 하지 말라는 내용의 지시를 듣고서 화가 나, “그걸 F에다가 얘기했어요 !”라고 다그치며, “씨발, 경찰에 신고하라고, 씨발, 뭐 이딴 년이 다 있어 아~, 죽여버리고 싶네, 너는 만질 게 없잖아!! 이제 징계위원회 조사 들어가고, 내 인생 조져 놓네.”라고 말하고, ④ 2012. 11. 16. 지하철을 타고...
