A defendant shall be punished by imprisonment for two years.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[1] On March 24, 2020, at around 00:52 on March 24, 2020, the Defendant: (a) sought a disturbance from the Eunpyeong-gu Seoul Eunpyeong Police Station C police box; (b) around March 15, 2020, at the above police box, he saw the disturbance as a violation of the Punishment of Minor Offenses Act; and (c) took the disturbance of “I will throw away, die, and throw away; (d) the police officer, etc. who belongs to the above police box sent the Defendant out of the police box; and (e) sought a disturbance at around 01:06, and “I want to take the right side of the police box before the front of the police box; and (e) I want to take the 1st of the police box at the right side of the police box at around 01:06.”
Accordingly, the defendant interfered with legitimate execution of duties concerning the prevention of crimes and maintenance of order by police officers.
On March 4, 2020, at around 00:45, the Defendant: (a) boarded a taxi operated by the victim E in front of the police box located in Eunpyeong-gu Seoul, Seoul on March 4, 2020; (b) had the victim drive a taxi while drinking, and had the victim go to the C police box without any justifiable reason; and (c) although it was confirmed that the police officer did not have driven a drunk, the Defendant was able to take a drinking test to the victim, the Defendant 20 minutes of the 20 minutes of the c police box, such as: (a) the victim was able to take a bath to the victim, and (b) the victim was unable to leave the scene.
Accordingly, the defendant interfered with the victim's taxi business by force.
