1. The defendant shall pay 300,880,000 won to the plaintiff and 15% per annum from September 1, 2007 to the day of complete payment.
Reasons
1. Indication of claim;
A. The Plaintiff filed a lawsuit against the Defendant with Seoul Eastern District Court 2007Gahap14764, which decided on December 26, 2007 that “the Defendant shall pay to the Plaintiff 300,880,000 won and the amount at the rate of 20% per annum from September 1, 2007 to the date of full payment,” and the above judgment was finalized on January 19, 2008.
B. The Plaintiff filed the instant lawsuit for the extension of extinctive prescription of the foregoing judgment claim while the Plaintiff was unable to receive the money from the Defendant.
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
