Defendant shall be punished by imprisonment for a term of one year and six months.

Punishment of the crime

[Attachment 1] Around March 26, 2018, the Defendant posted a letter to the Internet Bcarf C stating that “I will sell a Sogalthy mobile phone (S7)” and then sent a text message to the victim D who contacted with the fact that “I will deliver the mobile phone first if I will deliver the price of the object to be paid by the Party,” and then, he received KRW 140,000 from the victim D to the EF bank account (G) in the name of E used by the Defendant on the same day (Attached 1) and received KRW 140,000 from March 24, 2018 to March 27, 2018.”

[2] On July 27, 2018, at around 16:16, the Defendant (hereinafter “5187”) sent a letter to the Internet BC “C” and sent a text message to the victim H (hereinafter “H”) who reported and contacted the fact that “The Defendant would deposit KRW 195,000 won to be paid by the party, and send the text message to his/her home.”

However, since the defendant did not possess the opphones at the time, even if he received money from the victim H, he did not have any intention or ability to sell the money.

As such, the Defendant, by deceiving the victim H, received KRW 195,00 from the F bank account (Account Number: I) in the name of the Defendant as the price for the goods from the victim H, and received KRW 3,420,000 in total from 14 times in total from August 19, 2018 (attached Form 2) as stated in the list of crimes.
