1. The following portion of the part against the Plaintiff regarding the claim against Defendant B in the judgment of the first instance.
Reasons
1. Basic facts
A. 1) Trade Standards Co., Ltd. entered into a contract with mentmen Korea Co., Ltd. for the construction of a new plant in Ulsan-gu D, Ulsan-gu. The mentmen Korea Co., Ltd. entered into a subcontract with Hyundai Heavy Industries Co., Ltd. for the construction of the new factory in advance. The mentmen Korea Co., Ltd. entered into a subcontract with Hyundai Heavy Industries Co., Ltd. for the construction of the new factory in advance. The Hyundai Heavy Industries Co., Ltd. (hereinafter “Defendant C”).
B) The Defendant C entered into a subcontract with Defendant B Co., Ltd. (hereinafter referred to as “Defendant B”) on the construction cost of the said new factory (hereinafter referred to as “tight Standle”) at KRW 500,000,000 for the construction cost of the said new factory.
3) On October 30, 2012, Defendant B: (a) between the Plaintiff and the Plaintiff on October 30, 2012, set the construction cost of the instant construction works for manufacturing and installing valve stand stand (hereinafter “instant construction works”) at KRW 107,00,00; (b) did not separately make any additional settlement; (c) the raw materials are supplied to the Plaintiff by the Defendant B; and (d) the materials are supplied by the Plaintiff; and (c) the hedging on the white spling (referring to any operation that is set back later than a mountain amount in order to find the hedging on the black sprinks of the instant goods; and (d) the subcontracting contract under the condition that the construction of the instant construction works are excluded from the off-day sping work (hereinafter “instant subcontract contract”).
B) Around November 11, 2012, the Plaintiff started the instant construction work. Around November 13, 2012, the Plaintiff received design drawings on approximately 20% of the instant construction work, and around December 20, 2012, the design drawings on approximately 75% of the instant construction work.
