Defendant shall be punished by a fine of KRW 1,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. Forgery of private documents;

A. On April 11, 201, at around 13:50, the Defendant entered “B”, “B”, “C”, “D”, “E”, and “E” in the applicant’s contact column in the applicant’s contact address column, and marks the above E’s personal seal impression in the name, side, and after changing the name.

Accordingly, for the purpose of exercising, the Defendant forged one copy of a seal imprint incident/report on change in the name of E, a private document on rights and obligations.

B. The Defendant, at the same time and place as in the preceding paragraph, entered “B” in the account number column, “B” in the applicant’s address column, “B” in the contact column, “C” in the contact column, and “E” in the name of the Defendant’s name, and affixed the above E’s seal impression.

Accordingly, for the purpose of uttering, the Defendant forged a copy of the report under the name of E, which is a private document on rights and obligations.

2. The Defendant: (a) sent a forged seal impression incident/report and a report on the modification thereof to G, a bank employee, who is aware of the forgery at a time and at a place as referred to in paragraph (1), as if it were a document duly formed; and (b) exercised it respectively.

Summary of Evidence

1. A protocol concerning the police interrogation of the accused;

1. A complaint filed, a report on an accident or change of seal imprint, and a report on the change thereof;

1. Application of the statutes on video data from banks;

1. Relevant Article 231 of the Criminal Act concerning the facts constituting an offense, the choice of punishment, and Articles 234 and 231 of the Criminal Act (the occupation of exercising forged private documents and the selection of fines);

1. Of concurrent crimes, the former part of Article 37, Articles 38 (1) 2 and 50 of the Criminal Act;

1. The Act on May 14, 2014, which was amended by the former Criminal Act.
