1. Of the instant lawsuit, the Defendant’s Seoul Western District Court Decision 2018 tea14977 against the Plaintiff.

1. Basic facts

A. (1) On March 15, 2012, the Defendant entered into the instant service contract and the joint supply and demand agreement with C Co., Ltd. (hereinafter referred to as “C”) with the joint beneficiaries, and entered into a “specialized maintenance and management business agency contract” as a joint subcontractor in order to implement a housing redevelopment and improvement project with a size of 112,573 square meters in Eunpyeong-gu, Seoul (hereinafter referred to as “instant improvement project”). The main contents of the instant service contract are as follows.

Article 6 (Amount of Service and Payment Method) (1) The total amount of service costs under this contract shall be calculated by multiplying 11,709 won per square meter of the total floor space (including underground floors) among the new buildings, and value-added taxes shall be separately imposed: Provided, That the payment rate shall be calculated based on the total floor space determined at the time of completion of the project implementation authorization (including alteration). The 10 value-added tax shall also be paid at the time of the conclusion of the first contract for the establishment of the 15th new service costs when the authorization for the establishment of the 25th new service costs is granted at the time of the 20th approval for the establishment of the 3th service costs, the 25th service cost transfer announcement at the time of the designation of the 25th service costs and the 5th service cost. The 3th service cost to be paid by the Plaintiff to the Defendant and C shall be paid at the request of the Plaintiff within 7 days from the date of the establishment of the 3th service costs and the 17th service costs after the designation of the 3th service costs.
