A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant, on October 8, 2019, posted a letter stating that he/she sells a PS4 pro-type game machine in B Kaf, without the intention or ability to send the product, and sent the game machine to the victim C who reported and contacted the fact. Accordingly, he/she had the victim transfer KRW 330,00 to the E-bank’s charging account in the name of D bank (F) online gambling site. From that time to October 19, 2019, he/she acquired economic benefits equivalent to KRW 2,090,000 by deceiving five victims, as shown in attached Table 1.

2. No person who violates the National Sports Promotion Act shall gambling by issuing sports promotion betting tickets or similar things to persons who win up the results from such acts to provide property or property benefits;

Nevertheless, from October 2, 2019 to October 21, 2019, the Defendant: (a) transferred KRW 6,938,700 on 24 occasions, as shown in attached Table 2, from the illegal sports gambling site that imitates “G” on the official online sales of sports betting tickets, to the account in the name of E bank (F) in the name of D, a gold charging account; and (b) deposited money by printing KRW 10-2 million per time in domestic and overseas sports games; and (c) around that time, the Defendant spating the money at a certain rate of printing money depending on the appropriateness of the actual sports results.
