Punishment of the crime
[Status of the Defendant] From September 1, 2014 to January 8, 2017, the Defendant served as a general secretary in charge of accounting affairs at the Gosung-gun’s office; C is a person in charge of accounting affairs at the Gosung-gun’s office from January 15, 2016 to February 25, 2019; D is a person who operated the “F” at the Gosung-gun’s office; and D is a person who operated the “F” at the Gosung-gun’s office from around 2007 to from around 207.
[Public offering relation] The Defendant, in collusion with C and D, received a false estimate and a false tax invoice as if he was supplied with office supplies even without being supplied with office supplies from F, and then prepared a false invoice and a false tax invoice and submitted it to the expenditure department, respectively, and submitted it to the department in charge of expenditure, and then, when the victims high-income group remitted the amount of delivered office supplies to D account, the amount after deducting the value-added tax out of the amount was refunded to the victim high-income group, with the intention to arbitrarily use them in food expenses, business promotion expenses, etc.
[Specific Crime]
1. On January 26, 2016, the Defendant in collusion with C and D for the preparation of a false official document and the uttering of a false official document shall not purchase the office supplies equivalent to KRW 5,246,00 from D, even though he/she did not purchase the office supplies equivalent to KRW 5,246,00 from F, he/she received a false estimate and tax invoice from D, and based on such a false estimate and tax invoice, he/she entered the same falsely as if he/she purchased the office supplies as above, and made a false statement in the “written request for purchase of goods”, “the disbursement resolution”, and “written request for the inspection of goods”, and submitted them to H, who is a public official in charge, and had H approve approve of the fact that each of the above official documents was falsely prepared.
Accordingly, the Defendant, in collusion with C and D, refers to “goods purchased and requested,” which is an official document.
