2. 피고인은 2012. 8. 21.경 장소를 알 수 없는 곳에서 컴퓨터를 사용하여 인터넷 웹하드 사이트인 '예스파일(도메인명 www.yesfile.com)'에 피고인 명의로 가입된 ID 'F'(닉네임 G)으로 접속한 뒤, 같은 사이트 성인 게시판에 "[B][8월작]어떤 상황에서도 미소를 잃지않는 H 큐트", "[B]J컵 날씬한 폭유 간호사 I 그녀의 간호비결..", "[B][직샷]불평없이 면접에 합격 아마추어 폭유 여성의.과감.." 이라는 제목으로 성기가 노출된 전라상태인 남녀들의성행위 장면이 촬영된 음란한 동영상 3편을 게시하여 불특정 다수인이 볼 수 있도록 전시하였다.
